The Civil Unit is responsible for a broad range of essential services on behalf of Montrose County. These services include, but are not limited to:

  • Service of civil process (e.g., delivery of court documents)
  • Execution of court-ordered evictions
  • Delivery of legal documents pertaining to civil litigation, such as summonses, subpoenas, writs of restitution, and various court orders

Civil Process Fees

The Montrose County Sheriff’s Office accepts financial payment in the form of cash, check, debit card, or credit card.

  • All fees include a notary and return of service form.
  • A prepayment of $50.00 is required for all summons and complaints, and similar paperwork.
  • Mileage is $0.36 per mile, round trip from the sheriff’s office in Montrose or Naturita to the address of service and back. If more than one set of papers is served at the same address, only one mileage fee is charged. Mileage is rounded to a whole number. Refunds under $5.00 will be applied to mileage. Mileage is included in the cost of garnishments.
  • When actual costs for any service provided are less than the service fee or deposit provided, a refund will be issued by check.

Important Notice in the guide – Step 3: Personal Service


While Step 3 indicates that service must be completed at least seven (7) days before the return date, please note that if you intend for the Montrose County Sheriff’s Office to serve the documents, we must receive the paperwork no fewer than ten (10) days before the return date. This additional time is necessary to ensure timely and proper service.

This step is essential. Failure to have the documents served correctly and within the required timeframe may result in dismissal of your case by the court. If that occurs, you will be required to restart the eviction process from the beginning.
