A mittimus is a court order directing a law enforcement officer, such as a sheriff, to transport a person to jail. It authorizes confinement either:
- To serve a sentence after conviction, or
- To be held until their case is resolved in accordance with due process of law.
Essentially, a mittimus functions as a warrant of commitment. It typically includes the person’s name, the crime charged or convicted of, the designated place of confinement, and instructions for law enforcement to hold the person until lawfully discharged. A mittimus remains in effect until the individual named is apprehended and confined.
